2024 POOL RULES AND REGULATIONS
THERE IS NO LIFEGUARD ON DUTY AT ANY TIME! - SWIM AT YOUR OWN RISK!
1. The pool will open June 6, 2024 and closes September 2, 2024. The schedule is as follows:
June 6 through Aug 4: Mon - Fri 8am to Noon - Key hours
Mon - Fri Noon to 7:30pm - Pool Passes
Sat - Sun Noon to 7:30pm - Pool Passes
Aug 5 through Sept 2: Mon - Fri 8am to 4pm - Key hours
Mon – Fri 4pm to 7pm - Pool Passes
Sat - Sun Noon to 7pm – Pool Passes
The hours for Memorial, Independence & Labor Day: Noon to 7:00pm
The pool hours are subject to change and may be closed without notice.
Pool Passes may be purchased at the Association office beginning June 6th during office hours. EACH person entering the pool area MUST have a valid Pool Pass. New Passes are $10 each, Renewal Passes are free and Day passes are $3 each (10 day passes at a time and only after you have 5 guest passes). Pool monitors DO NOT sell pool passes. All tenants, lessees, and other non-owner residents must have an authorization form signed by the owner on file in the office before Pool Passes can be sold or renewed.
Pool keys for Key hours are available for a deposit of $50. Only one key can be issued to each Lot. ONLY ADULTS WILL BE PERMITTED USE OF THE KEY. Any child under 18 years of age using the Pool Key without adult supervision will have the key taken from them and the adult's $50 key deposit will be forfeited. Anyone using a pool key must make sure they and any guest(s) have valid pool passes. Pool Key use permitted while pool employees are on breaks. Any abuse of the pool key to allow entry of unauthorized persons will result in the key being taken and forfeiture of the $50 deposit.
Any violations of these Rules or any other applicable provisions of the Governing Documents subjects the violator to disciplinary action, including, but not limited to, immediate discharge from the pool compound. The violation(s) may result in temporary suspension or permanent revocation of the yearly pool pass and access to the swimming pool. Refusal to leave the pool compound or illegally entering the pool compound is a violation of California Penal Code Section 602(k) – Trespassing. Violators will be prosecuted.
THE GATE TO THE POOL AREA MUST REMAIN CLOSED AND LOCKED AT ALL TIMES.
THE POOL IS MONITORED BY CAMERAS.
Anyone using the swimming pool or entering the pool area must possess a valid Pool Pass.
1. The pool will be padlocked at closing and will not be unlocked until the pool reopens.
2. The pool is available during attendant hours for ONLY those persons who have authorized pool passes.
The pool is available during key hours for ONLY those with valid pool passes and with the permission of an
authorized key holder. NO EXCEPTIONS.
3. Any person using the pool does so entirely at their OWN RISK. The Association is not responsible for anyone’s safety.
4. NO DIVING ALLOWED! No cannon balls, jumping into pool, flipping into pool or any activity that the Pool
Monitor(s) or Board deems to be unsafe.
5. NO sitting, hanging, standing, pulling, jumping off, or pushing off the pool ladders. Pool ladders are used to
enter and exit the pool only.
6. Anyone fourteen (14) years of age and under MUST be accompanied by an adult (18 years old or older) during pool attendant hours. Anyone who requires supervision to use the swimming pool safely or to enter the swimming pool area safely must be supervised.
7. NO GLASS OR METAL items are permitted in the pool area.
8. NO SMOKING is allowed in the pool area.
9. NO RUNNING, dunking, wrestling, pushing, snapping of towels, cartwheeling, ROUGHHOUSING or other dangerous activities are allowed within the pool area.
10. NO bicycles, skateboards, scooters, roller blades, etc. are allowed in the pool area or around the gate.
11. NO PETS are allowed in the pool area.
12. NO alcoholic beverages are allowed in the pool area. Intoxicated persons will not be permitted in the pool
area.
13. No member, resident or guest shall remove ANY Association property from the pool area.
14. Foul, vulgar, violent, or obscene language will NOT be permitted.
15. Swimmers with hair six (6) inches or more in length, must wear a bathing cap or have their hair secured with a rubber band while in the pool.
16. Swim attire must be worn in the pool at all times. T-Shirts are the only non-swim attire that may in the pool and only if worn over swim attire. Persons in diapers and/or training pants MUST wear special swim diapers. Cut-offs, street clothes, gym/workout clothes and basketball shorts are expressly prohibited in the pool. Clean water shoes may be worn in the pool – the shoes cannot be worn outside the pool area.
17. Personal items, such as swim fins, flotation devices, face masks, snorkels, inflatable balls, etc. may be used at the discretion of the pool monitors or Board. All such equipment must be clean and safe to use in the pool and pool area and be in good working condition. Scuba gear, paddle boards, canoes, large rafts, remote control boats, or drones are not allowed.
18. All refuse, paper, wrappers, etc must be placed in the waste receptacles provided for this purpose.
19. Members and Residents shall have priority to use pool facilities unless the facility has been leased to another entity by the Association.
20. Members and residents may purchase up to five (5) guest cards per Lot. Guests may be excluded to prevent overcrowding of the pool. Only (10) day passes can be used per day per Lot.
21. Members are responsible for the conduct of their tenants, lessees, residents, family members and guests. All guests must be accompanied by a Member or resident. All pool users are, including guests, shall be subject to all pool rules.
22. Association members may be held financially responsible for any damage caused by the member or the member’s tenants, lessees, residents, family members, guests, and guests of any of the member’s tenants, lessees, residents, or family members.
23. The pool monitors, if any, has full responsibility for the enforcement of the above pool rules. No arguing with the pool monitor(s) is allowed. Being aggressive toward, threatening, or harassing the pool monitor(s) or anyone else in or around the pool area is prohibited. Any authorized sanction imposed by the Association official, while acting within the scope of their authority, shall remain in effect unless countermanded by the Board of Directors. Any grievance, dispute, or complaint will be directed to the Board of Directors.

Any Member, resident or guest not following rules while at the swimming pool or pool area will be given the following warnings:
1. Misconduct misbehavior
A. Depending on the severity of the behavior, the person may receive up to 3 verbal warnings. If the behavior continues, the person must leave the pool for 10 minutes. If the behavior continues, the person must leave the pool for that day.
B. If the person is asked to leave for the day, a Board Member will be called to discuss the situation.
C. The Board Member will then let the Office Manager know about the situation.
2. Significant Misbehavior:
A. Pool monitors must submit a written report as soon as possible after the incident.
B. The person must leave the pool for that day and does not get to come back until the next Board meeting; and must discuss the issue with the Board at a meeting and the Board will decide when the person can enter the pool again.
C. A Board Member needs to be called to discuss the situation.
D. The Board Member will then let the Office Manager know about the situation.
E. The Office Manager will write a letter to the Member to explain why the person must attend the next Board meeting to get their pool privileges back.
These Swimming Pool Rules and Regulations were adopted by the Board of Directors of the Union City Townhouse Association at an open meeting of the Board held on June 4, 2024, in compliance with Civil Code section 4360.

POOL PASS INFORMATION:
EACH PERSON WISHING TO ENTER THE POOL AREA MUST HAVE A CARD – ONE PERSON PER CARD.
BLUE CARDS: FOR RESIDENTS 13 AND OLDER. PICTURE I.D. NON-TRANSFERABLE. CHILDREN 14 YEARS AND UNDER MUST BE ACCOMPANIED BY AN ADULT, 18 YEARS OR OLDER (NO EXCEPTIONS).
YELLOW CARDS: FOR AGES 1 YEAR THROUGH 12 YEARS OF AGE. PICTURE I.D. NON TRASFERABLE. CHILDREN 14 YEARS AND UNDER MUST BE ACCOMPANIED BY AN ADULT, 18 YEARS OR OLDER (NO EXCEPTIONS).
WHITE CARDS: GUESTS OR RESIDENTS. NO MORE THAN 5 GUEST CARDS ARE ALLOWED PER RESIDENT CARD. GUESTS MUST BE ACCOMPANIED BY AT LEAST ONE RESIDENT WITH A VALID CARD. ALL CARDS MUST BE FROM THE SAME ADDRESS. CHILDREN 14 YEARS AND UNDER MUST BE ACCOMPANIED BY AN ADULT, 18 YEARS OR OLDER (NO EXCEPTIONS).
ORANGE CARDS: DAY PASSES. DAY PASSES ARE ISSUED ONLY TO THOSE WHO HAVE ALREADY PURCHASED FIVE (5) REGULAR GUEST PASSES FOR THE SEASON. EACH UNIT CAN ONLY HAVE UP TO TEN (10) DAY PASSES PER DAY. DAY PASSES ARE GOOD FOR ONE DAY ONLY. ALL DAY PASSES MUST BE ACCOMPANIED BY AN ADULT, 18 YEARS OR OLDER WITH A VALID RESIDENT CARD.
